The separation is necessary for the following reasons:

SCAA is currently acting both as a Regulator and Operator. This is inconsistent with international standards and practices.

A clear separation of functions between the (Regulator) SCAA and the (Operator) SAA is expected to reduce potential conflicts of interest.

The separation will ensure a high level of security standards, and promote compliance with international aviation agreements, of which Seychelles is signatory.

The SAA shall be primarily responsible for acquiring, establishing, developing, maintaining, and operating airports in Seychelles.

The SCAA shall be responsible for establishing and enforcing civil aviation regulations to the highest level of safety and security standards both nationally and internationally.

The SCAA shall also be responsible for business development in civil aviation such as national airports and airlines developments, environment and economic regulations, and support the state in matters relating to civil aviation.

The process is summarised as follows:

The SCAA through consultation and assistance from the Ministry responsible for Transport, Attorney General’s Office and other relevant authorities submits a draft to the National Assembly.

The National Assembly upon voting shall transmit to the President of the Republic for final approval.

The Attorney General’s Office shall then release a formal publication.

The Minister responsible for Transport shall, by way of Notice issue a commencement date for the laws which shall then be formally publicised by the Attorney General’s Office.

The Minister shall additionally issue a transfer date to which the airports and aerodrome related matters shall be transferred to the SAA by the SCAA and the SCAA shall consequently retain regulatory and oversight functions.

Both entities shall primarily generate revenue by monies from operations and prescribed fees (e.g. levies, etc.) and payments.

Appointments of the Board and CEO are made in accordance with the applicable national laws.

For the Board Members of both entities, appointments shall be made by the President of the Republic in consultation with the national committee responsible for the nomination of senior corporate executives and non-executive officials, together with the responsible Minister.

For the CEO, the appointment shall be made by the Board in consultation with the President of the Republic through the responsible Minister.

There are no immediate impacts anticipated for airport users during and post transition.

All contracts with stakeholders and operators shall be transferred to the appropriate entities (SAA or SCAA) in accordance with their functions and operations.

Employees will be transferred in accordance with their functions and duties respectively, to the appropriate entities.

Employee contracts shall be transferred under the same terms and conditions.
